F.
North Carolina Mountain Real Estate - The Offer and Contract

94. Receive and review all Offer to Purchase and Contract documents submitted.
95. Evaluate properties and/or offer(s) for comparison purposes.
96. Counsel clients on offers. Explain merits and weakness of properties and/or offers.
97. For sellers- review buyer’s qualifications and discuss offer.
98. Deliver Sellers Disclosure form to client prior to offer being made if possible.
99. Confirm client is pre-qualified. Obtain pre-qualification letter. Negotiate all offers on client’s behalf, setting time limit for loan approval and closing date.
G. 100+
Prepare and convey all counteroffers, acceptance or amendments. Fax copies of contract and all addendums to closing attorney, lender, transaction coordinator, 1031 Qualified Intermediary, and other parties as required. When an Offer to Purchase Contract is accepted and signed make sure everyone involved has a signed copy. Record and promptly deposit earnest money in appropriate Trust Account. Disseminate “Under-Contract Showing Restrictions” as seller requests. Deliver copies of signed Repair Agreement to seller. Fax/deliver copies of documents to all parties as needed/requested. Fax copies of documents as needed.
Provide copies of signed Offer to Purchase contract for office file. Advise clients of handling any additional offers to purchase that may be submitted between contract
and closing. Observe and/or Change status in MLS to “Backups Requested” “Sale Pending” and “Closed.”. Offer three (3) referrals for attorneys, home inspectors, appraisers, etc. If seller-financed, provide information. Assist investor-clients with referrals for obtaining financing. Coordinate with lender. Deliver property information to buyer and/or seller.
H. Tracking the Loan Process
Confirm Verifications of Deposits. Follow Loan Processing through to the underwriter. Contact lender weekly to ensure process is on track. Relay final approval of buyer’s loan application to seller.
I. Home Inspection
Coordinate buyer's professional home inspection. Review home inspector’s report. Explain client’s responsibilities with respect to loan limits and interpret clauses in the contract. Ensure seller’s compliance with Home Inspection Clause requirements. Recommend or assist seller with identifying and negotiating with trustworthy contractors to perform any required repairs.
J. The Appraisal
Schedule appraisal. Provide comparable sales used in market pricing to appraiser. Follow-Up on appraisal. Assist in reviewing appraisal report with clients.
K.
North Carolina Mountain Real Estate - Closing Preparations and Duties
Make sure that each page of the Contract Is Signed By All Parties and notarized if required. Coordinate closing process with all parties. Update closing forms & files. Ensure all parties have all forms and information needed to close the sale. Coordinate closing. Confirm closing date and time. Assist in solving any title problems (boundary disputes, easements, etc) or in obtaining Death Certificates. Work with clients in scheduling and conducting Final Walk-Thru prior to closing. Research all tax, HOA, utility and other applicable pro-rations. Request final closing figures from closing attorney.
Receive & carefully review closing figures to ensure accuracy of preparation. Forward verified closing figures to client if received before closing. Request copy of closing documents. Confirm buyer has received title insurance commitment. Provide “Home Owners Warranty” for availability at closing, if applicable.
Review all closing documents. Forward closing documents to absentee client, if applicable. Review documents with closing agent (attorney). Provide earnest money deposit check from escrow account to closing agent. Coordinate this closing with next/relocation transaction and resolve problems. Have a “no surprises” happy closing event.
For sellers--Change MLS listing status to Sold. Enter sale dates and price, seller broker and agents ID numbers, etc. Answer questions about filing claims with Homes Owner Warranty Company. Respond to any follow-up calls and provide additional information.
